SB 763 Transfer Development Rights Bill

Audubon Society of Portland worked with the Oregon Chapter of the American
Planning Association (OAPA) and the Nature Conservancy (TNC) to make
significant legislative changes to Senate Bill 763.

SB 763 revised the state law governing the establishment of transfer of
development credit (TDCs) systems in the State of Oregon. The initial
draft of the bill was focused entirely on enabling TDC systems to protect
forest and farmland sending areas outside urban growth boundaries (UGBs)
to any land inside UGBs.

Portland Audubon, TNC, and OAPA jointly advocated for amendments to the
establishment of TDCs to conserve state and local conservation priority
areas and other natural resource lands important for water quality,
natural hazards, and biodiversity located inside and outside UGBs.

Portland Audubon played a critical roll in advocating for legislation that
would allow for TDC systems that foster livable and ecologically
sustainable urban communities and advance Oregon's priorities for
protecting ecologically significant natural resource lands.

SB 763 passed the house and senate and is expected to be signed by the
governor.
